DIFC has announced a proposal for amendments to select laws through the DIFC Laws Amendment Law, Law No. 1 of 2005. These proposed changes are primarily clarificatory and aim to align DIFC laws with international best practices. One significant aspect of the amendments is the enhancement of the Data Protection Law, which will provide additional protections and rights of action for data subjects within the DIFC.

Among the proposed changes to the Data Protection Law, DIFC intends to clarify the scope of application and the extra-territorial reach of the law. This ensures that DIFC data subjects receive full protection regardless of where their data is processed. Furthermore, Article 28 will be updated to allow the Commissioner to reassess the adequacy standards for third countries that receive personal data. The amendments also aim to ensure that personal data processed by government authorities is adequately protected and that suitable redress is available for data subjects.
Additionally, the DIFC is proposing to introduce a Private Right of Action through its courts. This will enhance the rights and remedies available to data subjects whose personal data has been improperly processed. Other legislative amendments are also being considered concerning the Law of Security, Insolvency Law, and Employment.
The details of the proposed Amendment Law are outlined in Consultation Paper No. 1 of 2025, which has been made available for a 30-day public consultation period. The deadline for submitting comments on the proposed amendments is March 26, 2025.
